Terms of Use

Uncharted Travels is a global travel discovery, comparison, editorial and affiliate platform.

We provide users with tools and content to discover:

• tours
• safaris
• activities
• experiences
• accommodation
• destinations
• travel services
• travel deals
• travel information
• travel-related products and services

Unless expressly stated otherwise, Uncharted Travels is not the operator, supplier, tour company, accommodation provider, airline, transport provider or merchant responsible for the travel product displayed on the Platform.

Our role may include providing information about third-party travel products and directing users to the relevant supplier or booking platform.

Travel products displayed on Uncharted Travels may be provided by independent third-party suppliers.

Examples may include tour operators, activity providers, accommodation providers, booking platforms, affiliate networks and other travel businesses.

When you select a product and proceed to book, you may be redirected to the supplier's website or booking platform.

The contract for the travel product may be between you and the relevant supplier.

The supplier's:

• terms and conditions
• cancellation policy
• refund policy
• booking conditions
• privacy policy
• payment terms
• travel requirements

may apply to your booking.

You should review those terms before completing a purchase.

Unless a particular service expressly states otherwise, Uncharted Travels does not itself complete the booking, collect the supplier's booking payment or issue the supplier's travel voucher.

A “Book”, “Check Availability”, “View Deal” or similar button may redirect you to a third-party supplier.

Once you leave the Platform, your transaction may be governed by the third party's terms.

We aim to provide useful and accurate information, but travel prices and availability can change frequently.

Information displayed on Uncharted Travels may originate from third-party suppliers or affiliate partners.

Accordingly:

• prices may change
• availability may change
• promotions may expire
• taxes or fees may change
• currency conversions may fluctuate
• product descriptions may be updated by suppliers
• booking conditions may differ from information displayed on our Platform

Where there is a discrepancy between information displayed on Uncharted Travels and the supplier's booking platform, the supplier's current booking information should be treated as authoritative before purchase.

We do not guarantee that any particular product, price, discount or availability will remain available.

Some links on the Platform are affiliate links.

If you click an affiliate link and subsequently complete an eligible transaction, Uncharted Travels may receive a commission from the relevant supplier, affiliate network or partner.

Creators and other partners participating in our referral programme may also receive commissions or rewards for eligible bookings attributed to their links.

Affiliate relationships do not necessarily increase the price paid by the customer.

We aim to identify affiliate relationships clearly where required by applicable law.

Certain Platform features may require an account.

When creating an account, you agree to provide accurate and current information.

You are responsible for:

• maintaining the confidentiality of your login credentials
• keeping your account information accurate
• notifying us of unauthorised account access
• all activity occurring through your account where reasonably attributable to you

You must not create an account using false information or impersonate another person.

Uncharted Travels may offer a Creator, Ambassador or Partner programme.

Participation may be subject to additional programme rules.

Creators may receive tracking links, referral codes, storefronts, content tools and other features.

Participation does not create an employment, agency, franchise, partnership or joint-venture relationship unless expressly agreed in writing.

Creators are independent participants in the programme.

Where applicable, creators may earn commissions on eligible transactions attributed to their approved tracking links or referral mechanisms.

Commission calculations may depend on:

• supplier attribution
• booking status
• cancellation
• refund
• supplier reporting
• fraud checks
• applicable commission rates
• programme tier
• attribution windows
• other programme rules

A commission may initially appear as pending or provisional and may subsequently be adjusted, cancelled or reversed.

No commission is earned merely because a person:

• joins the Creator Programme
• recruits another creator
• generates a click
• generates an impression
• creates content

Commission eligibility is based on qualifying travel transactions or other expressly defined revenue-generating activity.

Where Uncharted Travels operates a creator referral network, creators may receive an additional reward based on qualifying bookings generated by creators they directly refer and, where expressly provided by the programme rules, creators within an additional referral level.

Recruitment itself does not generate a commission.

No payment is made merely for introducing or recruiting another creator.

Any network reward must ultimately be linked to qualifying commercial activity, such as an eligible travel booking.

The applicable commission rates, attribution rules and qualification requirements may be published separately in the Creator Programme Terms.

Uncharted Travels reserves the right to change programme rates and rules prospectively, subject to applicable law and any contractual commitments already made.

Uncharted Travels may offer creators:

• hosted trips
• discounted trips
• free trips
• travel credits
• promotional experiences
• bonuses
• other rewards

Eligibility may depend on qualifying performance, booking volume, revenue generated, content participation or other programme requirements.

Rewards are not guaranteed merely because a creator joins the programme.

Specific reward terms may apply to individual campaigns.

Creators may submit or publish:

• photographs
• videos
• reviews
• written content
• social-media posts
• destination guides
• recommendations
• other creative material

You retain ownership of content you create unless otherwise agreed.

By submitting content to Uncharted Travels, you grant us the licence necessary to host, display, reproduce, distribute, adapt, format and promote that content in connection with the Platform and the relevant creator programme.

The precise scope, duration, territory and commercial use of this licence should be confirmed in the applicable Creator Agreement.

You represent that:

• you own or have appropriate rights to the content
• you have permission to use identifiable persons appearing in the content where required
• the content does not knowingly infringe another person's rights
• the content does not contain unlawful material
• the content complies with applicable advertising and platform rules

Creators may connect supported social-media accounts to the Platform.

By connecting an account, you authorise Uncharted Travels to perform the actions permitted by the relevant integration and the permissions you grant.

Depending on the platform, this may include:

• retrieving permitted profile information
• publishing authorised content
• scheduling content
• uploading media
• retrieving publishing status

You remain responsible for complying with the terms and policies of the relevant social-media platform.

You may disconnect a social account at any time using available Platform controls or by revoking the relevant authorisation.

Uncharted Travels does not require your social-media password.

Uncharted Travels may publish:

• destination guides
• travel articles
• reviews
• product comparisons
• recommendations
• deals
• newsletters
• creator content
• AI-assisted content
• other editorial material

Editorial content is provided for general informational purposes.

Travel information can change and may become outdated.

We do not guarantee that every article, review, recommendation, price, destination detail or travel requirement is complete or current.

You should independently confirm important travel information with the relevant supplier or official authority.

Where the Platform permits users or creators to submit reviews, reviews must reflect genuine experiences.

You must not:

• submit fake reviews
• impersonate another reviewer
• submit reviews in exchange for undisclosed payment
• manipulate ratings
• submit defamatory or unlawful material
• artificially inflate or suppress a product's rating

We may moderate, remove or refuse content that violates these Terms or applicable law.

Deals, discounts, coupons and promotional offers may be provided by third parties.

Unless expressly stated otherwise:

• Uncharted Travels does not guarantee that a promotion will remain available
• suppliers may impose eligibility requirements
• promotional codes may expire
• discounts may be subject to restrictions
• suppliers may change or withdraw promotions

The supplier's current terms govern the actual purchase.

You agree not to:

• use the Platform unlawfully
• attempt to gain unauthorised access
• interfere with Platform security
• introduce malicious code
• scrape or harvest information in violation of applicable law or our instructions
• manipulate affiliate tracking
• generate fraudulent clicks or bookings
• create fraudulent accounts
• manipulate reviews
• impersonate another person
• misuse creator referral links
• engage in spam
• infringe intellectual-property rights
• use the Platform to distribute unlawful or harmful content

We may suspend or terminate accounts involved in abuse, fraud or other prohibited activity.

Unless otherwise stated, the Platform and its original materials are owned by or licensed to Uncharted Travels.

This may include:

• software
• source code
• interface design
• trademarks
• logos
• graphics
• databases
• original editorial content
• Platform structure
• branding

You may not reproduce, modify, distribute or commercially exploit our proprietary materials without appropriate permission.

Third-party trademarks, logos and content remain the property of their respective owners.

The Platform may integrate with or link to third-party services.

These may include:

• travel booking platforms
• tour operators
• accommodation providers
• affiliate networks
• payment providers
• social-media platforms
• analytics services
• AI providers
• other travel-related services

We do not control third-party services and are not responsible for their availability, security, content, terms or privacy practices.

Your use of those services may be governed by separate terms.

Unless expressly stated otherwise, travel payments are made directly to the relevant third-party supplier or booking platform.

Uncharted Travels may receive an affiliate commission from a supplier or affiliate network.

Where Uncharted Travels directly administers creator payouts or other payments, additional payment terms may apply.

Where you book directly with a third-party supplier, cancellation and refund requests should generally be directed to that supplier in accordance with its booking terms.

Uncharted Travels does not control a third-party supplier's cancellation or refund policy unless expressly stated otherwise.

Where Uncharted Travels directly administers a programme benefit or creator payment, the applicable programme terms will apply.

Travellers are responsible for determining and obtaining the documentation and permissions required for their journey, including where applicable:

• passports
• visas
• vaccinations
• health documentation
• insurance
• entry permits
• transport requirements
• destination-specific requirements

Travel requirements may change.

You should verify current requirements with relevant official authorities and the applicable supplier before travelling.

Uncharted Travels does not guarantee:

• the quality of a third-party travel service
• the conduct of a supplier
• the availability of accommodation
• the safety of an activity
• the accuracy of third-party descriptions
• the supplier's compliance with its advertised itinerary
• uninterrupted operation of a third-party service

Any claim concerning the performance of a third-party travel service should generally be directed to the relevant supplier.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

To the extent permitted by applicable law, the Platform is provided on an “as available” basis.

We do not guarantee that:

• the Platform will always be available
• the Platform will be error-free
• information will always be complete or current
• third-party services will remain available
• affiliate links will always function
• prices or availability will remain unchanged

We will, however, take reasonable steps to maintain and improve the Platform.

To the maximum extent permitted by applicable law, Uncharted Travels will not be responsible for indirect, incidental, consequential or special losses arising from:

• third-party travel services
• third-party websites
• cancelled or changed bookings
• inaccurate third-party information
• supplier conduct
• travel interruptions
• loss of data
• unauthorised access caused by circumstances outside our reasonable control

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

The lawyer should review this clause carefully for compliance with applicable consumer-protection law and enforceability.

To the extent permitted by law, you agree to indemnify and hold Uncharted Travels and its officers, employees, contractors and partners harmless from claims, losses, liabilities and expenses arising from:

• your unlawful use of the Platform
• your breach of these Terms
• your infringement of another person's rights
• fraudulent activity associated with your account
• creator content that you submit
• misuse of affiliate or referral systems

This clause does not apply to the extent that the relevant loss resulted from our own unlawful conduct, negligence or other liability that cannot legally be excluded.

We may suspend or terminate access to the Platform where reasonably necessary, including where:

• you breach these Terms
• we detect fraud or abuse
• continued access creates a security risk
• required by law
• the relevant service is discontinued

Where appropriate, we will provide notice before termination.

Termination does not affect rights or obligations that accrued before termination.

We may update these Terms from time to time.

Where changes are material, we will provide reasonable notice where required.

Your continued use of the Platform after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.

Our processing of personal data is governed by our Privacy Policy.

The Privacy Policy forms part of the framework governing your use of the Platform.

These Terms shall be governed by the laws of Kenya, unless applicable mandatory law provides otherwise.

The parties shall seek to resolve disputes through good-faith discussions before commencing formal proceedings where appropriate.

The lawyer should confirm the appropriate jurisdiction, dispute-resolution mechanism and any mandatory consumer protections applicable to users outside Kenya.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These Terms, together with any applicable additional programme terms, policies or agreements expressly incorporated into them, constitute the agreement governing your use of the relevant Platform services.
